RIM sinks, but patents, network have value

WATERLOO, Ontario (AP) ? Research In Motion Ltd., the maker of the BlackBerry, is in steep decline. The company, once the crown jewel of the Canadian technology industry, is now worth 1 percent of Apple's market capitalization. One way for RIM to stop the downward tailspin: It could sell itself to a competitor or financial firm. But who would step up to buy RIM ?and why?

Late Tuesday, the company said it expects to post an operating loss for the current quarter, a sign that BlackBerry sales are falling even faster than analysts expected. On Wednesday, the company's stock hit its lowest level since 2003, the year RIM went from making two-way e-mail pagers to smartphones.

The stock has fallen 93 percent since their peak in 2008. Since then, the BlackBerry's dominance as the smartphone for on-the-go business people has been eviscerated by Apple Inc.'s iPhone, and more recently, by phones running Google Inc.'s Android software. Research firm IDC says BlackBerrys now account for 6.4 percent of the global smartphone market, a third of what they had two years ago.

In that time, the company's financial performance has suffered. RIM reported a 25 percent revenue decline in the latest fiscal quarter, to $4.2 billion from $5.6 billion. For the full fiscal year that ended on March 3, it earned $1.2 billion, or $2.22 per share, on revenue of $18.4 billion. That's down from net income of $3.4 billion, or $6.34 a share, on revenue of $19.9 billion in fiscal 2011.

RIM issued the dire warning about its business Tuesday, adding that it will lay off a "significant" number of employees.

Still, the company is defiant. Chief executive, Thorsten Heins, says he can turn things around with the help of fresh smartphone software. Heins joined RIM four years ago and was most recently its chief operating officer. He replaced co-CEOs Balsillie and Mike Lazaridis in January after the company lost tens of billions in market value.

"My charter from the board of directors is very clear: long-term value creation with RIM," Heins told The Associated Press in an interview at the company's headquarters in Waterloo, Ontario, earlier this month.

Analysts give RIM only a slight chance of coming out of the crisis. To hedge its bets, the company has hired bankers to look at its options. It's not actively looking to sell itself, Heins said, but it wants to be prepared.

"We are prudent because we know the situation is somewhat challenging," Heins said. "So we are just looking at everything that could be an option. That doesn't mean we are pulling on those options. But we need to understand ... what is our field of action that we could take in case we need to?"

As RIM's prospects worsened, last year marked a turning point in the way analysts assess RIMs value. Instead of treating it like a company with a future, they started looking at it as a collection of parts that could be split up and sold separately to the highest bidder.

Michael Walkley at Canaccord Genuity believes most of the company's value lies in the monthly fees it gets from phone companies in exchange for running the systems that deliver email and Web pages to BlackBerrys.

RIM has 78 million users connected to this system, but Walkley estimates that only 20 million are corporate and government users who are likely to stick around because of the communications security RIM provides. The rest are consumers who will jump to competing phones, he believes. That business is worth about $2.75 billion to a competitor, Walkley wrote in a research report Wednesday.

The other major component of RIM's value is its patent portfolio. The company had an early scare in U.S. patent courts in 2006, when it was forced to pay $612.5 million to a small company founded by an inventor who had patents on wireless e-mail delivery. Since then, it's filed for thousands of patents to use as a defense against future suits.

Patents on wireless technologies exploded in value last year, as Apple and Microsoft Corp. started suing makers of phones that run Google's Android software. Countersuits followed. A consortium that included Apple and RIM bought the patents of a defunct Canadian maker of telecommunications gear, Nortel, for $4.5 billion last year. That compares with the $1.13 billion Nortel's once-prominent wireless networks business fetched in 2009.

As a counter-move, Google bolstered its own patent portfolio by buying Motorola Mobility Holdings Inc., a U.S. phone maker with only slightly better prospects than RIM, for $12.5 billion.

Where does that leave RIM? Christopher Marlett, the CEO of MDB Capital, said RIM's patents are worth more than $1 billion, and could be worth as much as $4 billion if a bidding war develops between Apple, Google, Microsoft Corp. and perhaps Samsung Electronics Co.

"It's a question of how aggressive they get," Marlett said. His firm is an investment bank that focuses on intellectual property, including patents.

Walkley puts the value of RIM's portfolio at $2.5 billion, excluding the patents RIM bought from Nortel and shares with Apple, Microsoft and other buyers.

RIM has $2.1 billion in cash, but Walkley discounts this completely, since the phone business will likely start using up cash soon, and downsizing will require severance payments. That means the email network and the patents comprise RIM's entire value at $5.25 billion, by his estimate.

That's very close to RIM's current market capitalization, at $5.4 billion, though a buyer could be expected to pay a premium.

The cash cushion also means that RIM is in no imminent danger of going bankrupt. But as the shares decline, RIM is likely to face increasing pressure from shareholders to unlock the company's value through a sale, and to abandon the comeback plan.

A possible middle ground would be to sell the patent portfolio while keeping the rest of the company. Two months ago, AOL, once a pioneering Internet service provider, sold and licensed its patents ?which are more modest than RIM's for $1 billion? to Microsoft.

Microsoft is one company that's been suggested as a potential RIM buyer. The software juggernaut is trying to get back into smartphone software, but its Windows Phones haven't been popular so far. Buying RIM could give it a chance to establish itself as a provider of trusted wireless email services, though moving subscribers from BlackBerry to Windows could be challenging.

You may recall a little MTV "After Hours" segment called "Erotica," in which Josh Horowitz had the cast of "Snow White and the Huntsman" read an excerpt from "Fifty Shades of Grey."

While Chris Hemsworth could barely make it through the reading, Kristen Stewart laughed at some of the lines, Charlize Theron attempted to act out the scene and Sam Claflin wooed us with his luscious tone.

When we caught up with Stewart and Claflin again for MTV's Sneak Peek Week, leading up to Sunday's MTV Movie Awards at 9 p.m. ET, we asked the "Twilight" star if reading the erotic tale sparked her interest in the role of the timid Ana Steele.

"They should ask me!" she joked. "No, I'm kidding. [During 'After Hours'], that was the first time I read it."

Stewart is currently up for two Movie Awards along with her "Breaking Dawn" co-stars. Through the Movie of the Year and Best Kiss categories, she has a shot at the coveted Golden Popcorn. Voting is still open, so head over to MovieAwards.MTV.com to make your voice heard! And who knows, maybe "Snow White" will grab some nominations next year. Until then, we're pretty sure Sam Claflin has a future in erotica books on tape.

"To be honest, having watched that back, I took it way too seriously," the actor laughed as he recalled the "After Hours" video. "All four of us did very different readings, but I actually properly read it. I got really into it."

Stewart didn't disagree. She gave it a good try, but Claflin is unbeatable.

"What happened to Sam before he was an actor? I was trying to get a job," he joked. "I will do anything for money."

Horowitz brought out all three books in the "Fifty Shades" trilogy wrapped in a ribbon for both actors as a going-away present. Now they have their own copies of E L James' series to take with them as they travel. Though don't expect to see KStew reading her copy as she jets off to and from LAX.

"When people read this on airplanes," she said, "I'm like, 'Whoa. Take that blanket off your lap! Get off the plane. Sick!' "

Claflin, however, has a different reaction.

"I'm like, 'Can I borrow that after you?' "

On June 5 in the Americas and June 6 in the rest of the world, people will be able to see one of the rarest predictable events in astronomy: a solar transit of the planet Venus. Over a six-hour period the disk of Venus will be silhouetted against the sun. Seeing it safely requires a special eye-protection filter, available for a dollar or so?alternately, a telescope or binoculars can safely project an image onto a wall or sheet of paper. But if you miss it, your next chance won't come until the year 2117.

Every century or so, the relative orbital motions of Earth and Venus bring them into perfect alignment with the sun, producing a pair of transits separated by eight years. Only six transits have been observed in history: in 1639; 1761 and 1769; 1874 and 1882; and 2004. Observing them was once the "noblest problem in astronomy" (as an English Astronomer Royal put it), because until the 20th century it was the only way to determine the distance from Earth to the sun. Hundreds of expeditions went as far north and as far south as possible to make giant triangles with Venus and thereby maximize the precision of the measurement. The most famous was probably Captain Cook's voyage to Tahiti in 1769.

Transits have lost none of their capacity to surprise astronomers. At the time of the 2004 event, nobody alive had seen one. I remember watching it on images streaming back from NASA spacecraft. When Venus was about halfway onto the sun's edge, the planet?s atmosphere became visible, bending sunlight toward us. This unexpected phenomenon has led us to plan worldwide observations of Venus's atmosphere during the upcoming event. We should be able to detect a dimming of the sun by a tenth of a percent as Venus blocks that much of the sun's disk. Our view should help researchers interpreting Venus's atmosphere with the European Space Agency's Venus Express spacecraft. In addition, it provides ground truth for the Kepler spacecraft's observations of exoplanetary transits around other stars.

I personally will observe from the University of Hawaii's solar telescope on Haleakala volcano on Maui, supported by the Committee for Research and Exploration of the National Geographic Society. I hope to incorporate results from the space-based observations in time to include them in my address to the American Astronomical Society in Alaska the following week. And we hope that people in 2117, as the next transit of Venus approaches, look back at the scientists of 2012 and say we carried on with skill the tradition of Captain Cook and the Astronomers Royal.

Choosing if you should buy comprehensive health insurance is never easy, also it needs several factors to be weighed and analyzed. Firstly, you?ll want to assess your own hazard to health and how much you?re able to do to lessen it via your own effort. The greater you can care for your own body, the less chance there is that you will fall vulnerable to disease. You will need to be covered up against the unforeseen and against accidents, but you can definitely save money which could then be redirected into savings plans. Injured Passenger Initiates Unsual Car Accident Compensation Claim

An unusual car accident compensaiton claim has been initiated by a woman who sustained serious personal injuries in a car accident whilst abroad in Poland. The woman is seeking ?300,000 in personal injury damages for the incident. The car accident compensation claim writ was recently submitted to the High Court in London and picked up on by a local newspaper named the Huddersfield Daily Journal. It seems that the woman, who is 28 years old is a local to the area, was riding as a passenger in the back seat of the car. A family member was driving the Fiat punto which was insured by a Polish company. Their small vehicle collided with a BMW whilst approaching a cross-junction in the road and the blame for the incident is being put on the Fiat driver.

The woman, who now lives Jagger Lane which is in Honley, is filing the car accident compensation claim against the Polish insurance company of the car in which she was riding as a passenger. The Polish insurance company is based in Poland?s capital, Warsaw and has representatives in the United Kingdom at Inter Europe in Trafford Park in Manchester. The legal team representing the woman state that the personal injury claim must be met as the insurance company is bound by Polish Law to do so. The man driving the Fiat was facing a conviction in June of last year but had his jail sentence suspended by a three year probationary period at the Polish courts. The car accident took place in the south of Poland near a small town called Skoczow which is close to this Silesian foothills.

The list of extensive personal injuries sustained in car accident include fractures to sacral bones and a series of complex fractures sustained to the woman?s right leg. Also reported is a fractured left collarbone, fractures in the neck, a fractured pelvis and also a brain injury. The car accident compensation claim writ states that the woman still suffers to this day due to the personal injuries which happened in the beginning of last year. So far, it?s thought that this car accident happened as the Fiat driver was negligent and failed to pay sufficient attention to the road in order to spot the BMW at the junction. The outcome of this road traffic accident claim remains to be seen.

GM signs 5-year deal to sponsor Manchester United

(AP) ? General Motors is still working out how it will spend the money it is saving by scrapping ads on Facebook and pulling out of the Super Bowl.

But it has decided that at least some will go toward a five-year deal to make Chevrolet the official automotive sponsor of the popular British soccer club Manchester United.

GM formally announced the partnership on Thursday, saying that it's part of the plan to make Chevy an iconic brand across the globe.

The company wouldn't say how much the deal will cost, and Paul Edwards, its executive director for global marketing strategy, said it has nothing to do with GM's decisions earlier this month to scrap a $10 million advertising spend on Facebook and to pull out of next February's Super Bowl.

Manchester United claims to be the most popular sports franchise in the world. According to research done for the team, its fan base has doubled in the past five years to 659 million people, nearly one tenth of the world's population. Half of the fans are in Asia, especially in China, where GM sells more cars than in any other country.

While the deal should help Chevy globally, GM will keep strong ad campaigns and sponsorships in each of its regions, including sporting events and concerts in the U.S., Edwards said.

"That doesn't mean we're walking away from Major League Baseball here in the U.S., or the National Football League," he said. "We're still deeply engaged with those sports for the U.S. audience."

GM, he said, is still working out its 2012-2013 advertising campaigns, but it will have a heavy presence in the U.S. during the upcoming Summer Olympics being held in London.

"That is a U.S. media buy that we're leveraging because we see the value in terms of the audience we get," Edwards said.

The Detroit automaker said earlier this month that it would pull its advertising dollars from Facebook because they were not effective. GM said it will no longer pay for ads on the right side of Facebook pages, but it would continue to have pages for its cars, trucks and brands. Facebook doesn't charge for those pages, but GM spends millions on videos and other content for them.

The company also said it realizes the Super Bowl has a huge audience, but it pulled out after CBS, the network airing next year's game, raised prices. The Nielsen Co. said an estimated 111.3 million people in the U.S. watched the New York Giants beat the New England Patriots in this year's Super Bowl, slightly more viewers than in 2011.

GM, Edwards said, will spend the Super Bowl money in more places more often to attract a big audience. "We can invest that money and better engage our consumers in a deeper and sustained way," he said.

Shunning Facebook and the Super Bowl brought criticism of GM from the advertising and auto industries, and it left many wondering about GM's strategy. For instance, the Super Bowl audience would have been a perfect for the company, which will introduce new pickup trucks next year.

But Edwards said GM will reach truck customers with other events such as the Olympics and football and baseball games leading up to the Super Bowl that last a whole year rather than just one day.

GM still plans to spend $4.5 billion globally on advertising this year, the same amount as last year. Edwards said regional spending also will remain steady.

Manchester United got its fan base data from the Kantar research firm, which surveyed 54,000 people in 39 countries. A similar survey in 2007 indicated that Manchester United had 333 million fans, based on 27,000 responses.

The phone will arrive in limited numbers, but neither Nokia nor Phones 4u is spilling the beans on precise unit numbers. (AP) ? Authorities in Miami are looking for more witnesses after a police officer fatally shot a naked man who refused to stop chewing on the face of another naked man on a busy downtown highway ramp.

Detective William Moreno said police are looking for people to fill in the blanks on what led to the grisly scene in which a witness reported that a man ? later identified by authorities as Rudy Eugene, 31 ? savagely chewed on the other man's face and growled when a police officer kept telling him to stop.

The victim, who has not been identified, has been hospitalized in critical condition.

"We know that there were many people on the MacArthur Causeway and we're hoping they come forward," Moreno told The Miami Herald on Monday.

Miami police have released few details about the weekend attack, other than confirming that there was a fatal officer-involved shooting. Messages left Monday by The Associated Press for a police spokesman were not immediately returned.

Witness Larry Vega was riding his bicycle Saturday afternoon off the MacArthur Causeway that connects downtown Miami with Miami Beach when he saw the savage attack.

"The guy was, like, tearing him to pieces with his mouth, so I told him, 'Get off!'" Vega told Miami television station WSVN (http://bit.ly/L6kwWt). "The guy just kept eating the other guy away, like, ripping his skin."

Vega flagged down a Miami police officer, who he said repeatedly ordered the attacker to get off the victim. The attacker just picked his head up and growled at the officer, Vega said.

As the attack continued, Vega said the officer shot the attacker, who continued chewing the victim's face. The officer fired again, killing the attacker.

A surveillance video camera from The Miami Herald building nearby captured images of the men's naked legs lying side by side after the shooting.

Vega said the victim appeared gravely injured.

"It was just a blob of blood," Vega said. "You couldn't really see, it was just blood all over the place."
